Court dismisses contractor’s case against Earthbanc

Eldoret, April 30, 2026 — The High Court in Eldoret has dismissed a case filed by Green Planet Initiative 2050 Foundation against Earthbanc AB, bringing to a close a dispute linked to the Regeneration Kenya Project.
The court ruled in favour of Earthbanc AB and its local subsidiary, Earthtree Company Limited, rejecting all claims and requests made by the contractor. It also ordered the plaintiff to pay the legal costs incurred by the defendants.
In its judgment, the court found that the case lacked merit, legal foundation and substance. It further criticised the contractor’s conduct, pointing to accountability gaps during its time as an implementing partner.
The court noted that a party that fails to meet its contractual obligations cannot seek to enforce the same contract against the other party.
Green Planet Initiative 2050 Foundation had been engaged to support the implementation of the Regeneration Kenya Project. However, the partnership was terminated in April 2025 after internal assessments found that the contractor had failed to meet compliance, operational and quality standards.
Court records also show that the contractor acknowledged that no payments were owed by Earthbanc AB.
Following the ruling, Earthbanc AB said it will continue advancing its land restoration and nature-based solutions across different regions, while thanking its investors, partners and communities for their continued support.
