NAIROBI, September 16, 2026 — Wiper Patriotic Front and Azimio la Umoja One Kenya Coalition Party leader Stephen Kalonzo Musyoka has welcomed the High Court decision nullifying the Government’s sale of a 15 per cent stake in Safaricom PLC, describing the judgment as a victory for Kenyans.
Speaking at the SKM Command Centre in Nairobi on Wednesday, Kalonzo said the ruling had reaffirmed the constitutional principles governing the management and disposal of public assets.
“The people have won. Safaricom is coming home,” Kalonzo said.
He addressed the media alongside Democratic Party leader JB Muturi and DAP-K Party leader Eugene Wamalwa following the court’s decision on the disputed transaction.
The High Court declared the sale unconstitutional, invalid, null and void and ordered the 15 per cent stake to be restored to the Government of Kenya on behalf of the Kenyan people.
Kalonzo, who served as Lead Counsel in the constitutional petition challenging the transaction, said the legal process had been driven by the need to protect the interests of Kenyans and safeguard one of the country’s major public assets.
“It has been a privilege to walk through this legal journey and represent Kenyans in court against the sale of one of our country’s most valuable national assets,” he said.
According to Kalonzo, the judgment goes beyond the specific transaction and reinforces the responsibility of public institutions to ensure that decisions involving public assets comply with the Constitution.
“This judgment is more than a legal victory,” he said. “It reaffirms the sovereignty of the Kenyan people, the supremacy of the Constitution, and the principle that public assets must be managed transparently and in the public interest.”
The leaders said the court’s decision had also highlighted the importance of public participation, accountability and transparency whenever the Government undertakes transactions involving public assets.
They called on Kenyans to remain vigilant in protecting strategic national assets and upholding constitutional principles.
The leaders’ remarks come as the Government considers its next legal steps following the judgment, with the possibility of an appeal expected to prolong the dispute.
Kalonzo said any future management or disposal of public assets must strictly adhere to constitutional requirements, including meaningful public participation and accountability.
The Safaricom case has consequently opened a wider conversation on how strategic public assets should be managed and the safeguards that should be observed before such assets are transferred or disposed of.
For Kalonzo and other leaders, the court decision represents an important moment in that debate, with the focus now shifting to the implementation of the judgment and any further legal proceedings that may follow.
